Areas of Practice
Mr. Birker’s practice involves a variety of transactional business matters, with a strong emphasis on real estate. He represents both buyers and sellers of raw land and commercial and industrial real property. His work includes drafting and negotiating purchase and sales agreements, loan agreements, and related contracts as well as due diligence and title matters. Mr. Birker also handles real estate development entitlement and land use matters on behalf of developers and owners of real estate. His work includes the negotiation of development agreements with governmental agencies, acquisition and disposition of environmental mitigation land, and various types of agreements between property owners, including improvement, reimbursement, cooperation, easement and license agreements.
Mr. Birker also performs a substantial amount of real estate leasing work. He represents both landlords and tenants in real property leasing transactions involving raw land, commercial, office and industrial property. In the recent economic downturn, he has performed a substantial amount of lease restructuring and sublease work. He also handles loan transactions on behalf of owners of real property, including loan agreements and loan restructuring.
Mr. Birker also forms corporations, partnerships and limited liability companies on behalf of the firm’s clients. He also drafts and negotiates co-tenancy agreements and management agreements.
Mr. Birker also performs general business work, including drafting and negotiating business contracts. He also engages in estate planning work, including drafting wills and revocable and irrevocable trusts.

Education: California State University at Northridge (B.A.,cum laude, 1976); Loyola University of Los Angeles (J.D., cum laude, 1979), Phi Alpha Delta. Recipient: American Jurisprudence Award in Criminal Procedure, 1978; American Jurisprudence Award in Evidence, 1978.
